اسلامی‌سازیِ قوانین از مهم‌ترین رسالت‌های جمهوری اسلامی است که تحقق آن از مسیر کنشگریِ شورای نگهبان به مثابه نهادی ناظر ترسیم شده است. با وجود نقش‌آفرینیِ مؤثر شورا در ادوار مختلف، چالش‌های متعددی فراروی آن وجود دارد. فتوای فقهی‌ای که باید سنجۀ این پایش قرار گیرد، بنیادی‌ترین مسئلۀ مطرح در این عرصه است. در اثر حاضر، ضمن تحلیل و نقد نظریات ناظر بر فتوای معیار در قانونگذاری، ضعف همگی در حل تعارض موجود در تعامل میان تقنین و تقلید به تصویر کشیده شده، و در این راستا نظریه‌ای ارائه شده که بتواند این مشکل را برطرف سازد، بدون آنکه نه مکانت قانون در جامعه تخدیش شود، و نه الزام مبتنی بر فتوای برآمده از اجتهاد یا تقلید با محذور روبرو شود. ضرورت اجرایی‌سازی این راهکار با آسیب‌شناسی پایش شورای نگهبان در دو قانون جامع کیفری مصوب 1392، قوانین مجازات اسلامی و آیین دادرسی کیفری، به‌شکلی عینی قابل درک خواهد بود.

The Islamicization of laws is a significant mandate of the Islamic Republic, which is envisioned to be realized through the active engagement of the Guardian Council as a supervisory institution. Despite the Council's effective role in various periods, it faces numerous challenges. The jurisprudential decree (fatwā) that must serve as the benchmark for this oversight represents the most fundamental issue in this domain. In the present book, an analysis and critique of the theories pertaining to the benchmark decree in legislation is conducted, highlighting the shortcomings of mainstream approaches in resolving the existing conflict between taqnīn (legislation) and taqlīd (regular reliance on a Muslim religious authority and conforming to his judgments on questions of canon-law and matters falling within the domain of religion). In this context, a theory is proposed that aims to address this issue without undermining the status of law in society or encountering dilemmas related to obligations derived from ijtihād (juristic interpretations) or taqlīd. The necessity of implementing this strategum will be elucidated through a critical examination of the Guardian Council's oversight in the two comprehensive penal codes ratified in 2013, namely the Islamic Penal Code and the Code of Criminal Procedure
